What prompted the initial contact with police? At just before 3 p.m. on April 21, 2022, Hettinger County Sheriff’s Deputy Jed Kohler responded to a 911 call of a disturbance at the local public school. Upon arrival Deputy Kohler made contact with Jeffrie Glover, the man whose ex-wife had called to report having a custody issue with over their young child.  

Actions taken by subject towards police: After cursing about his wife to Deputy Kohler, Glover walked out of the school but then stormed back inside, bumping into the kids as he went into the cafeteria. Deputy Kohler followed Glover into the cafeteria where after a warning which Glover did not heed, Deputy Kohler tased him. As Deputy Kohler then tried to handcuff Glover, Glover pulled the deputy down to the ground with him and said he was going to kill him. When Deputy Kohler got up and moved away from Glover, Glover charged at him and was tased again but to no effect. Glover bear hugged Deputy Kohler, causing the deputy to be tased as Glover fell on him and knocked him unconscious.

Reactions by the police: Deputy Kohler regained conscious to find himself being choked by Kohler. Fighting for his life, Deputy Kohler started to pull out his knife, causing Glover to retreat. As Deputy Kohler started putting his knife away, Glover moved aggressively toward him again, this time reaching for the deputy’s knife or gun. With Glover just inches away, an exhausted and afraid Deputy Kohler fatally shot him.

Outcome of investigation into the fatal police incident: After reviewing all the details of the shooting compiled by the North Dakota Bureau of Criminal Investigation, the prosecutor concluded the shooting was justified and declined to file charges against the deputy.

What could the subject have done that day to still be alive today? Glover could still be alive if he: remained outside the school and did go back inside bumping into the kids; complied with Deputy Kohler’s commands; did not attack the deputy; did not choke the deputy; did not go for the deputy’s knife or gun.

Justified Use of Deadly Force? YES, Deputy Kohler had been beaten, tased, and choked as he tried to arrest Glover. Exhausted, the deputy reasonably feared Glover was going to take his duty gun or knife and murder him with it, so he justifiably used deadly force.
