What prompted the initial contact with police? At approximately 5 a.m. on February 13, 2022, a Concord police officer “observed a white male suspect trying to steal a vehicle” from a car dealership.
Actions taken by subject towards police: Despite numerous commands to stop his illegal activity and peacefully surrender, the male refused to comply and instead fought with the officer.
Reactions by the police: The officer escalated from physical force to deadly force and fatally shot the suspect during the struggle.
Outcome of investigation into the fatal police incident: The North Carolina State Bureau of Investigation is conducting the investigation.
What could the subject have done that day to still be alive today? The man could still be alive if he: did not commit a burglary and draw the attention of the police; peacefully complied and been arrested; did not fight with the officer.
Justified Use of Deadly Force? YES, the officer was alone, in the middle of the night fighting with a violent criminal suspect. The combination of these factors would lead the officer to have a reasonable cause to believe if the suspect could knock him/her out and/or take their duty weapon then the officer’s life would be endangered – so justifiable deadly force was used.
