Criminal Activity History/Involved: Yes, Alder Alfonso was arrested and charged with carrying a concealed weapon on July 14, 2021. Neighbors described Arturo as a “violent person and abusive to his then wife” and “would shoot his gun in the air for no reason.” / Unknown what circumstances brought Deputy Byrd into contact with the perpetrators, but it is known Alder Marin-Sotelo was an illegal alien and wanted for previous charges.

What prompted the initial contact with the killer? Sometime after 11 p.m. on August 11, 2022, Deputy Sheriff Ned Byrd parked his unmarked patrol vehicle near a gas station and exited it to investigate something or someone.

Actions taken by subject toward police: Arturo Marin-Sotelo, his brother Alder Alfonso Marin-Sotelo, and another male relative shot Deputy Byrd multiple times, leaving him dead on the roadway.

Reactions by the police: After Deputy Byrd did not respond to radio transmissions, other deputies went to his last known location and found him dead from multiple gunshots. Using video from the dash camera and nearby surveillance systems, law enforcement officers identified the three male suspects. A nationwide manhunt was conducted and officers tracked down the Marin-Sotelo brothers and their male relative and arrested them within a few days.

How murdered? Deputy Byrd was apparently ambushed and fatally shot.

What could have been done differently for the officer to still be alive? Impossible to determine without knowing more details and/or seeing videos of the incident.

Would the officer have been justified to use deadly force before being murdered? There are no reports of Deputy Byrd having fired his weapon, so he never had the chance to use justified deadly force.

Outcome for the cop-killer: The Marin-Sotelo brothers have been charged with murder and charges are pending on the third man.

Miscellaneous: When Alder Alfonso was arrested for illegally possessing a concealed loaded gun in 2021, he admitted to being a Mexican national and entering the United States illegally.  Despite being an illegal alien illegally possessing a loaded weapon, Alder Alfonso was given a court date and released instead of being immediately deported. He never showed up for his court dates in July and September of 2021 and now we have a dead deputy sheriff who could have still been alive if America’s immigration laws were enforced.
