What prompted the initial contact with the killer? At approximately 3:30 a.m. on January 3, 2003, San Antonio Police Officer David Evans and Detective John Bocko responded to a 911 call of a domestic violence incident at a Denny’s restaurant in San Antonio. A woman reported her boyfriend, Jamie Lichtenwalter had forced her at shotgun point to the restaurant so he could confront the man he suspected she was cheating on him with.  Upon arrival the officer’s located Lichtenwalter and the woman and were able to deescalate the situation to the point they were going to send the couple “on their separate ways.”

Actions taken by subject toward police: Lichtenwalter sucker punched Det. Bocko, breaking his jaw and then took his duty weapon, shooting both Det. Bocko and PO Evans multiple times, Lichtenwalter took the duty weapon from the injured PO Evans as well. PO’s Nathan Murray and Michael Muniz responded as back-up and ran towards the restaurant to render aid to PO Evans when he stumbled from it. Lichtenwalter followed PO Evans outside and opened fire on POs Murray and Muniz, hitting them both and engaging them in hand-to-hand combat.

Reactions by the police: Though seriously injured, PO Muniz managed to return fire at Lichtenwalter, fatally striking him as he was so close he fell on top of Muniz on the ground.

How murdered? PO Evans was shot several times while handling a domestic dispute, he suffered from his injuries for over 19 years before eventually succumbing to them.

What could have been done differently for the officer to still be alive? Given the nature of the 911 call and Lichtenwalter’s size, it would have been prudent for the officers to treat him as a dangerous threat and not let him get within striking distance of them.

Would the officer have been justified to use deadly force before being murdered? The moment Lichtenwalter assaulted Det. Bocko and started removing his gun, PO Evans was justified to use deadly force.

Outcome for the cop-killer: Lichtenwalter was justifiably shot dead by PO Muniz during the attack.

Miscellaneous: Had Lichtenwalter been kept in prison to serve his full sentence, these four officers and their families would not have had their lives irreparably altered.
